1. Agreement to Terms

Welcome to livematchGOLF. These Terms and Conditions ("Terms") constitute a legally binding agreement between you, whether personally or on behalf of an entity (“you”), and livematchGOLF (“Company”, “we”, “us”, or “our”), concerning your access to and use of our website, currently located at livematch.golf, and any associated services, features, content, or applications (collectively, the "Service").

By accessing or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Service and must discontinue use immediately.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our data practices.

2. Subscriptions, Fees, and Payment

The Service is currently provided free of charge. We reserve the right to introduce fees for certain features or to change the features included in the free tier of the Service at any time.

Should we introduce any premium subscription plans or paid features in the future, all applicable fees, billing cycles, and payment terms will be clearly disclosed to you before you commit to any purchase. We will provide you with reasonable prior notice of any changes to pricing or subscription models that may affect you.

3. User Accounts and Acceptable Use

Account Creation and Eligibility: To access certain features of the Service, such as the admin dashboard, you must register for an account. You agree to provide accurate, current, and complete information during the registration process. You must be at least 18 years old to create an account and use our Service.

Account Security: You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your login credentials.

Prohibited Activities: You agree not to use the Service for any purpose that is illegal or prohibited by these Terms. You specifically agree not to:

  • Use the Service for any form of illegal gambling or wagering.
  • Harass, abuse, impersonate, or harm another person or group.
  • Upload or transmit viruses, worms, or any other malicious code.
  • Attempt to gain unauthorized access to our systems, user accounts, or data through hacking, password mining, or any other means.
  • Scrape, reverse-engineer, decompile, or otherwise attempt to derive the source code of the Service.
  • Use the Service to infringe on the intellectual property rights of others.
  • Submit false or misleading information.
4. Privacy Statement

We are committed to protecting your privacy. This statement explains how we collect, use, and protect your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

a. Information We Collect
  • Account Information: When you sign up, we collect your name and email address to create and manage your account.
  • User-Generated Content: We store the data you create, including event names, division details, player names, and match scores, to provide the core functionality of the Service.
  • Technical Data: We may process technical information, such as IP addresses, for security monitoring and to maintain the integrity of our Service.
b. How We Use Your Information

Your data is used solely to:

  • Provide, operate, and maintain the Service.
  • Communicate with you about your account or important service updates.
  • Ensure the security of our platform and prevent misuse.
c. Data Storage and Security

Browser Storage for Critical Functions: To enhance your experience and prevent data loss, livematchGOLF uses your browser's local storage capabilities (such as sessionStorage) for strictly necessary functions. This includes temporarily saving your scoring progress during a live session so that it can be recovered if your browser is accidentally closed or refreshed. This data is not used for tracking and is essential for the reliable operation of our scoring features.

All other account and event data is stored securely using Google Firebase services.

d. Your Data Protection Rights

Under UK GDPR, you have rights including the right to access, rectify, or request erasure of your personal data. You can manage your account details, including requesting account deletion, directly from your "My Profile" page after logging in. Alternatively, you can request deletion by contacting us at support@livematch.golf. We will handle your request promptly, although some information may be retained as required by law or for legitimate business purposes.

Please note that while your account will be deleted, your name may still appear in past match results to maintain the historical accuracy of event records.

You also have the right to lodge a complaint with the UK Information Commissioner's Office (ICO) if you believe your data protection rights have been infringed. See ico.org.uk for details.

e. Lawful Basis for Processing

We process your personal data under the following lawful bases:

  • Contract: to create and administer your account and provide the Service.
  • Legitimate interests: to secure and improve the Service, prevent fraud/abuse, operate support, and communicate essential service updates.
  • Consent: for optional marketing communications. You may withdraw consent at any time.
f. Data Retention

We retain personal data only as long as necessary for the purposes described above:

  • Account data: kept while your account is active. Upon deletion, core account data is removed within 30 days, subject to legal requirements.
  • Operational logs: retained up to 12 months for security and troubleshooting.
  • Backups: encrypted backups may persist for up to 30 days.
  • Event history: player names and match results may remain visible in historical leaderboards to preserve competition records.
g. International Transfers and Processors

We use Google Firebase/Google Cloud to host and operate the Service. Our primary data location is europe‑west2 (London, UK). Some ancillary processing (e.g., global content delivery networks or email providers) may involve international transfers. Where transfers occur outside the UK/EEA, we rely on appropriate safeguards such as the UK Addendum to the EU Standard Contractual Clauses (SCCs) or equivalent mechanisms.

h. Cookies and Local Storage

We use strictly necessary browser storage and service worker caching to operate key functionality (e.g., preserving in‑progress scoring and enabling offline performance). We do not use advertising cookies. If we introduce analytics or other non‑essential cookies in the future, we will request your consent and provide an opt‑out.

i. Sharing and Disclosure
  • Club/Group administrators: Administrators of the organisation you join may access relevant member/event data for management purposes.
  • Public leaderboards: Match and leaderboard information is public by design to enable viewing and sharing.
  • Service providers: We engage trusted vendors (e.g., hosting, email) under data processing agreements.
  • Legal: We may disclose information as required by law or to protect rights, safety, and security.
  • No sale of personal data.
j. Children’s Privacy

The Service is not directed to individuals under 18 years of age, and we do not knowingly collect personal data from children.

k. Marketing Communications

We may send service/transactional messages related to your account. We will only send optional marketing communications with your consent, and you can opt out at any time via the message footer or by contacting us.

l. Automated Decision‑Making

We do not perform automated decision‑making or profiling that produces legal or similarly significant effects about you.

5. Intellectual Property Rights
a. Our Intellectual Property

The Service and all of its original content, including but not limited to all source code, databases, functionality, software, website designs, text, graphics, photographs, logos, and trademarks (collectively, the “Content”), are owned by or licensed to us, and are protected by copyright and trademark laws. Except as expressly provided in these Terms, no part of the Service and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

b. Your License to Use the Service

Provided that you are eligible to use the Service, you are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Service and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Service and the Content.

c. User-Generated Content

You are solely responsible for the content you create, upload, or post to the Service, including but not limited to event names, player names, and scores ("User Content"). You retain all ownership rights in your User Content. However, by submitting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform the User Content in connection with operating, promoting, and improving the Service. You represent and warrant that you have all the rights, power, and authority necessary to grant the rights granted herein to any User Content that you submit.

6. Disclaimers and Limitation of Liability
a. Service "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. YOU AGREE THAT YOUR USE OF THE SERVICE WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICE'S CONTENT AND WE WILL ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, OR ANY BUGS, VIRUSES, OR THE LIKE WHICH MAY BE TRANSMITTED THROUGH THE SERVICE.

b. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE GREATER OF (A) THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING OR (B) ONE HUNDRED POUNDS STERLING (£100.00).

c. Legal Exceptions

NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT OUR LIABILITY FOR DEATH OR PERSONAL INJURY ARISING FROM OUR NEGLIGENCE, OR OUR FRAUD OR FRAUDULENT MISREPRESENTATION, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY ENGLISH LAW.

7. Account Termination

Termination by You: You may terminate your account at any time through the self-service account deletion feature on your "My Profile" page. Alternatively, you can contact us at the email address provided below.

Termination by Us: We reserve the right, in our sole discretion, to suspend or terminate your account and refuse any and all current or future use of the Service at any time, without prior notice, for any reason, including, but not limited to, a breach of these Terms. Upon termination, your right to use the Service will immediately cease.

8. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your User Content; (2) your use of the Service; (3) your breach of these Terms; or (4) your violation of the rights of a third party, including but not limited to intellectual property rights.

Our site may contain links to third-party websites. We are not responsible for the content or accuracy of these sites and do not endorse them. Use them at your own risk.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this site and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

11. Governing Law and Dispute Resolution

These Terms and your use of the Service are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales. We encourage you to contact us first to seek a resolution for any dispute informally.

12. General Provisions

Entire Agreement: These Terms and any policies or operating rules posted by us on the Service constitute the entire agreement and understanding between you and us.

Severability: If any provision or part of a provision of these Terms is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions.

No Waiver: Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.

The Service is provided without any uptime guarantee and may be unavailable from time to time due to maintenance, updates, or outages. Features may change, be deprecated, or be removed at our discretion.

If you believe content available through the Service infringes your intellectual property rights, please contact us at support@livematch.golf with a detailed description of the alleged infringement and sufficient information to identify the content.

17. Export Controls and Sanctions

You represent that you are not located in, under the control of, or a national or resident of any country or entity subject to UK, EU, or U.S. embargoes or sanctions, and you agree to comply with applicable export control laws and regulations.
